How to Open a Tuition Centre in Malaysia: Licences and Requirements

First, the legal picture: tuition centres are regulated by KPM

Tuition centres in Malaysia are private educational institutions under the Education Act 1996. Section 132 of the Act makes it an offence to operate an unregistered private educational institution, with a fine of up to RM30,000, imprisonment of up to two years, or both.

In practice this means a tuition centre must be registered with the Ministry of Education (Kementerian Pendidikan Malaysia, KPM) through the State Education Department (Jabatan Pendidikan Negeri, JPN) for the state where the centre is located. The registration form is commonly referred to as BPS I, and a licence is typically valid for four to five years before renewal.

Requirements and processing times vary by state and change from time to time, so treat everything in this article as a general guide and confirm the current rules with your JPN, SSM, Bomba and local council before committing to a lease.

The approvals most new tuition centres need

Most owners find that the KPM licence is the last piece, not the first. It usually depends on several other approvals being in place, which is why the sequence matters.

• SSM business registration: most centres incorporate a Sdn Bhd (the SSM incorporation fee is about RM1,010), although other structures exist. KPM commonly expects the centre name to follow a “Pusat Tuisyen …” style.
• Premises: commercial premises are generally required; residential units are usually not allowed unless the local authority permits it. A tenancy agreement and a layout plan are typically part of the application.
• Bomba: a fire department support letter or certificate confirming the premises meet fire-safety requirements.
• Local council (PBT): a premises licence and signboard licence, which typically take 15 to 30 working days, plus health and cleanliness compliance.
• People: the principal must be a Malaysian citizen, and teachers generally need at least SPM plus a teaching permit (permit mengajar) issued through KPM/JPN.
• Location: KPM generally does not approve premises next to hazardous, unsuitable or directly competing establishments.

Realistic timelines: months, not weeks

The single most common surprise for new owners is time. SSM incorporation can be quick, and council licences are measured in weeks, but a KPM/JPN assessment commonly takes many months because it depends on site inspection and on every supporting document being complete.

That waiting period is where many centres run into trouble: rent is being paid, renovation is done, and no classes can legally start. Planning for this gap is part of opening responsibly.

Common mistakes that delay or sink a new tuition centre

Most of the problems we hear about are not about teaching. They are about sequence and assumptions.

• Signing a lease on a shop lot before checking whether the council and KPM will accept that location and floor.
• Renovating before the layout plan has been reviewed, then having to redo walls, exits or toilets.
• Assuming an existing business licence covers tuition; KPM registration is separate.
• Hiring teachers without confirming they can obtain a teaching permit.
• Naming the centre something KPM will not accept and having to reprint everything.
• Opening with no curriculum, so parents cannot see progress and leave after a term.
